Nigeria: NBA urges Tinubu to stop IGP from enforcing tinted glass policy
The Nigerian Bar Association (NBA) has urged President Bola Tinubu to intervene and stop the Inspector-General of Police (IGP), Kayode Egbetokun, from enforcing the tinted glass policy, following the police's recent announcement to resume nationwide enforcement from January 2, 2026.
The NBA has threatened contempt proceedings against the IGP and other police officials if they proceed with the enforcement while the matter is still pending in court.
The NBA argues that the police's decision is an affront to the authority of the courts and a subversion of the rule of law. The association notes that a motion for an interlocutory injunction in its suit (FHC/ABJ/CS/1821/2025) at the Federal High Court, Abuja, was struck out on December 12, 2025, based on the police counsel's solemn undertaking that enforcement had been suspended.
The NBA described the policy as unconstitutional, illegal, and a military-era decree that falls short of democratic standards. It argues the police lack the legislative authority to impose fees on citizens for permits and has questioned the transparency of payments allegedly going into a private company's account.
The association highlighted that the enforcement had previously led to widespread reports of harassment, extortion, and civil rights violations. It further argued that the annual permit fee, which was previously reported around ₦14,200 or ₦16,000, imposes an undue financial burden on Nigerians already facing economic challenges.
The Police's Position
Security Concerns: The Nigeria Police Force insists the resumption of enforcement is necessary and urgent due to a disturbing rise in criminal activities, such as armed robbery and kidnapping, perpetrated with vehicles fitted with unauthorized tinted glass.
No Restraining Order: The police have maintained that no court has at any time restrained them from enforcing the law. Force Public Relations Officer, CSP Benjamin Hundeyin, clarified that the previous "suspension" was a voluntary administrative decision to allow motorists time to regularize their documents, not an adherence to a court injunction.
Professionalism Assured: The IGP has assured the public that the renewed enforcement, starting January 2, 2026, will be carried out with utmost professionalism, respect for citizens' rights, and in accordance with extant laws.
The NBA has directed its branches to provide legal support to any motorist harassed or prosecuted under the policy, setting up a potential legal conflict ahead of the new year.
